Report lodged with MACC against Zambry

State PKR vice-chairman Chang Lih Kang lodged a report with the MACC against Perak Mentri Besar Zambry Abdul Kadir for abuse of power and corruption.

Chang claimed that Zambry was responsible for Umno cronies getting state land meant for the poor and the landless in state.

Also named in the report was Umno Gopeng division chairman Hamzah Mohd Kassim.

Chang who handed over the report to MACC investigating officer Azaha Lias at 11am today will have his statement recorded tomorrow at the state MACC office.

He this came to light when Kampar district and land office displayed names of 127 eligible participants in the Sungai Itek village land scheme in Gopeng on Nov 24.

Ten lots had been allocated under a quota to the Umno Gopeng division. Hamzah took one lot and allocated the rest to his division’s eight committee members.

MACC to probe Gopeng land scam

IPOH, Dec 16 — The Malaysian Anti-Corruption Commission (MACC) will initiate investigations into an allegation that a quota of land plots meant for the poor in Gopeng had been given to an Umno division chief and his cronies.
Also implicated in the allegation is Perak Mentri Besar Datuk Seri Dr Zambry Abd Kadir, who holds the land portfolio in the state executive council.
The case’s investigating officer confirmed to The Malaysian Insidertoday that the complainant in the matter, Teja assemblyman Chang Lih Kang, had been summoned to give a statement at the commission’s Perak branch here, at 2pm tomorrow.
“Once we record his statement, we will summon in the others who were named in the complaint,” he said when contacted. The officer, however, did not confirm if the commission would summon Zambry in its investigation.
Chang, who is also the Perak PKR vice-chairman, is alleging that 10 out of the 127 plots of land under the Sungai Itek planned village programme had been allocated to Gopeng Umno committee members, including its chief Datuk Hamzah Kassim and the latter’s business partner, Syarul Nizam Mohamad Shahidan.
He told reporters after lodging his report at the MACC here this afternoon that the plots of land should rightfully be given to the poor and the landless of the Gopeng constituency.
“Hamzah is an Ipoh city councillor. He has his own home in Taman Pinji Perdana and is even the director of three private companies. He does not have a need for the land,” said Chang.
Chang added that Hamzah is also the biggest shareholder in property development and trading firm, Star Ventures Sdn Bhd, of which Syarul Nizam is the director.
He said that according to information obtained from the Companies Commission of Malaysia, Hamzah had once been appointed as a director of the firm but resigned from the post on Sept 14 this year.
The others who have allegedly been selected as participants under the Sungai Itek programme include seven Gopeng Umno division committee members, one division Youth committee member, and the division’s treasurer.
According to Chang, the names had been maintained on the list of participants even after the 14-day objection period from Nov 30 to Dec 13.
“From what we know, the final list has not yet been finalised. However, we believe that in the first place, no such quota should be given to these people whether to keep as their own or to distribute to others.
“This is very clearly a gross abuse of power and we hope that action is taken upon these people,” he said. Chang added that as the holder of the land portfolio and the Perak Umno liaison chief, Zambry should also be held responsible.
“He has misused his power and his position to enrich his Umno leaders,” he said.
Chang had highlighted the issue to the media last week, and had revealed the name list for the suggested participants under the Sungai Itek programme.
In the list, 35 plots were allocated to the identified squatters in the area, 52 to the pre-interviewed poor and landless, 10 to the Gopeng Umno division and 30 to village chiefs.
When contacted, Hamzah had told The Malaysian Insider that he had no say in the decision to select the participants in the programme.
He said that there was no wrong in his bidding for the land when given the opportunity to do so for as the Umno division chief, adding he had wanted to situate himself closer to his constituents for the purpose of offering them service and aid.
Hamzah had also said that it was the district land office’s decision to select the participants of the programme.
District land officer Ahmad Kamaruzzaman Hamzah had, however, told The Malaysian Insider that the quota for Umno and the village chiefs was meant to be distributed to the poor.
He had said that the district land office had enlisted the help of the division members and the local village to identify the poor and the landless who could qualify to become participants.

I am going to lodge a MACC report at 11am today, against the BN MB Dato’ Seri Zambry Abd Kadir and the UMNO Gopeng division chief, Datuk Hamzah Mohd Kassim.

I have given enough time, and Hamzah seems no repentance.

After a thorough check with SSM, we found that Hamzah not only allocated lands to his division committee members, but also to his business partner. Besides, we also found out that Hamzah is currently director of 3 companies and major shareholder for another 2 companies. And he got the RPT (Rancangan Perkampungan Tersusun) land. This is unscrupulous!

And Zambry, as the chairman for state land committee cum UMNO state liaison chief must be held full responsibility for this policy (that provides quotas to UMNO division chief).

Perak PKR cries foul over land for poor given to cronies

IPOH, Dec 8 — The Perak PKR has threatened to call in the graft busters on the Perak government if Mentri Besar Datuk Seri Dr Zambry Abd Kadir fails to stop the practice of giving land meant for the poor to rich Umno cronies.
Its vice-chairman Chang Lih Kang revealed recently that 10 plots of land under the planned Sungai Itek village programme were allocated especially for members in the Gopeng Umno division.
He said a list obtained from the district land office showed that a special quota of land plots was apportioned for the division members and village chiefs as those selected to be participants under the programme.
Also in the same list were the names of identified squatters in the area as well as the poor and landless who had already been interviewed by the district land office.
Of the total 127 plots, 35 were allocated to squatters, 52 to interviewed participants, 10 to Umno Gopeng division members, and the remainder to village chiefs.
Their names will be displayed for 14 days until Dec 13 at the district land office as participants under the programme to give time for objections to be made before the list is finalised.
“What we do not understand here is why there is a quota for Umno members when there are so many others in the constituency who are poor and need the land,” he told The Malaysian Insider.
Chang said that those who were listed in the Umno quota were already well-off and did not need the land.
“I do not know if this is common practice in all the other districts to allocate a special quota to Umno members but this is not the way things should be done.
“Many of those who had appealed for the plots were turned away although they should have been qualified to receive them,” he said.
Chang said that under such planned village programmes, a 30 per cent quota of the total land plots would be allocated to the government to distribute to the poor.
“This should be given out to the poor and for the purpose of squatter relocation. But in this case, it is clear that some of the plots are simply being given to Umno cronies,” he said.
He urged Zambry to review the state government’s land policies to ensure that such a practice was stopped for good.
“If he fails to do this, I will lodge a report to the Malaysian Anti-Corruption Commission (MACC),” he said.
Chang added that he would check to see if the plots of land under the Sungai Itek planned village programme were actually given to the Umno cronies after the objection period this Dec 13.
“If they are approved, we will lodge a report with the MACC for corruption and abuse of power,” he said.
Meanwhile, when contacted, Gopeng Umno division chief Datuk Hamzah Mohd Kassim whose name is the first on the quota list for Umno, scoffed at Chang’s allegations.
He told The Malaysian Insider today that he had not been the one to decide on who would get the plots of land.
“Naturally when there are schemes like this, there is nothing wrong for us to apply for the land. However, it is up to the district land office concerned to make the decision on who should get it,” he said.
He added that as the Gopeng Umno division chief, he too had a duty to serve the rakyat in the constituency.
“I was bidding for that plot of land so that I can be closer to the constituents there and help the people,” he said.
Hamzah insisted that he had no power over the decisions made by the district’s land committee and hence had no say over who should get land.
“Naturally we would put in our applications and it is up to them to select whomever they see as qualified. There is nothing wrong with that,” he said.
Hamzah’s words were however contrary to the information that The Malaysian Insider obtained from district land officer Ahmad Kamaruzzaman Hamzah later today.
According to Ahmad Kamaruzzaman, the plots of land were not meant to be used for the personal interests of those listed under the quota for the Umno members and the village chiefs.
When questioned by The Malaysian Insider, a surprised sounding Ahmad Kamaruzzaman said that the quota was created because those in it were supposed to help the district land office to identify the truly poor and landless.
“I asked them for help and this is why the quota was created. It is not for their personal use. They are supposed to help us locate those who are really poor and need the land,” he said.
He added that although interviews were conducted to identify the poor, not many interviewees were truthful of their economic situations.
“This is why we enlisted the help of these locals because they would know better than us,” he said.

Ini adalah kisah benar yang berlaku di Kg Tersusun Sg Itek, Gopeng. di mana kuota 10 lot tanah diberikan kepada Ketua Bahagian UMNO. Dan Ketua Bahagian UMNO Gopeng, Datuk Hamzah bin Mohd Kassim telah MENELAN satu lot sendiri (rujuk nama pertama di bawah Kuota Ketua Bahagian UMNO Gopeng). Dah ada pangkat Datuk, seorang ahli majlis Dewan Bandaraya Ipoh dan mempunyai sebuah rumah mewah di Taman Pinji Perdana, Hamzah masih tidak malu mengambil tanah kg tersusun yang disediakan khas untuk orang miskin.

IPOH, Nov 6 – The collapsed suspension bridge in Kuala Dipang that caused the deaths of three schoolchildren recently had been an illegal structure, Pakatan Rakyat’s ad hoc task force revealed today.
Task force member Teja assemblyman Chang Lih Kang told a press conference this afternoon that no application had ever been sent to the Kampar district council to seek approval before the bridge was built.
The bridge, he added, was worth about RM40,000 and had been constructed by a private company based in Kuala Lumpur as a contribution to the district education office.
“We have interviewed several people, including the Kampar district officer and the chief assistant district officer, but they revealed that the council was never informed of such a structure,” he said.
Chang said that before such a bridge could be built, an application would first have to be made with the council since the land was within the council’s jurisdiction.
“They will have to submit a ‘Borang A’ to the council and then, the council’s one-stop centre will send out the application to four different government agencies for further approval – the Health Department, Drainage and Irrigation Department (DID), Fire and Rescue Department (Bomba) and the Department of Environment,” he said.
Only if the structure satisfied all requirements, and all four departments gave the green light, would the council issue an approval.
“Once the structure is completed, a consultant engineer must issue a Certificate of Compliance and Completion,” he said.
In the case of the Kuala Dipang bridge, said Chang, none of the requirements had been met.
“In fact, we are not even sure if the company had employed any consultant engineer at all in the first place.
“Furthermore, according to DID guidelines, a construction like the bridge needs to have special measurements taken for the prevention of soil erosion.
“From our observation after we visited the site on Tuesday, no such measurements were taken. There were no retaining walls to hold up the structure and its base was built too close to the river,” said Chang.
Meanwhile, the task force’s chairman, Tronoh assemblyman V. Sivakumar said that, based on interviews with some of the children who witnessed the tragedy on Oct 27, there had been no teacher-supervisors watching over the children at the time of the incident.
“From what we were told, not more than five teachers were tasked to look out for the children during the time of the incident. The remaining group of teachers were apparently having a briefing session in the school building,” he said.
Apparently, during the time the group of schoolchildren were crossing the bridge, not a single teacher was keeping watch over them, he added.
“Before that, the students were told that they were only allowed to cross the bridge six at a time and before the incident, the teachers were careful to make sure of that.
“But later that night, no one supervised. That was why there were actually 22 students crossing the bridge at the same time,” said Sivakumar.
He added that as children, the group would naturally get playful and begin playing around with the handrails and jumping on the frail structure.
“That was when the bridge collapsed. And from what we were told, only three teachers had helped to rescue the children – two men and one woman. The others were busy in the meeting,” he said.
The incident, which occurred about 10.30pm that night, caused the deaths of N. Dina Deve and M. Devatharshini, both 11, and 12-year-old V. Divyashree.
The three had been participants in the Education Ministry’s 1 Malaysia unity camp which involved a total of 298 students from 60 schools in the Kinta Selatan district.
Furthermore, Sivakumar said that despite the large number of participants, only 30 teachers were employed to look after the children.
“Meaning, one teacher has to look after 10 children. To make matters worse, during that night, most of them chose to go for a briefing.
“Why do they need to have a briefing at the time when they should be taking care of the children?” he said.
Sivakumar added that the parents of the three deceased had also not been aware of where the camp would be taking their children and that there would be physical activities involved.
“As for the two 11-year-olds, they were not even supposed to be a part of the camp because it was actually meant for Standard 6 students.
“They were only told that there were not enough students on the very day itself,” he said.
He added that before their children were allowed to go for the camp, the parents of the students were made to sign disclaimer forms which absolved the authorities of all responsibility should any incident happen.
“But how can this be fair when the location of the camp itself was not safe and the parents are not even made aware of this?” said Sivakumar.
The PR ad hoc task force will set out to interview the district education department and the DID next as well as get a consultant engineer to study the structural defects of the bridge at the site.
They are also pushing for a public inquiry to be held on the incident.
The Education Ministry is also probing the incident and their investigations are estimated to be completed by the end of next week.

A lot of people are asking, what actually happened on the 28th of October sitting? I know what they meant, they are actually asking what happened after we entered the SUK compound but before we entered the hall. Because most of what happening before we entered SUK and after we entered the assembly hall were reported in the mainstream paper.

So I would like to start from the moment we crossed the gate of the SUK building. We were walking in a group, all 28 of us, and there were only 28 of us… Nizar was holding Sivakumar’s hand, as we anticipated the police might have aimed Sivakumar for his robe. (Sivakumar was on full Speaker’s attire)

True enough, a police officer named ASP Bala (the police in the pic) came to us and spoke in a very good manner. He told us he is not barring us from going, but he just wanted to serve Sivakumar a notice. It was already 10am, and the assembly was supposed to start. We asked ASP Bala to serve the notice after the assembly, because no assemblyman shall be harassed by any police when he/she is in the compound of state assembly. In fact, police can even be incriminated for doing so because under Section 124 of the Penal Code, anyone who blocks a lawmaker from carrying out his duties can be jailed up to 7 years!

Nizar alleges plot to attack PR lawmakers

LUMUT, Oct 24 – Former Perak Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin has alleged that the Barisan Nasional administration had “an evil plan” to attack Pakatan Rakyat lawmakers during the Oct 28 sitting if they attempted to stop any proceeding.

He claimed that “insiders” had informed him the BN had already terminated the services of the current sergeants-at-arms in the state assembly and had replaced them with 15 new ones, all from Umno.

“From what we were told, these 15 are ‘samsengs’ from Umno and come the state assembly sitting in Oct 28, they will be appointed officially as the new sergeants-at-arms,” he told a press conference after launching the Perak PR Youth at Markas PAS in Batu 9, Lekir.

He added that his source had also told him that five PR assemblymen were targetted and would be victims of violent attacks in the event that the tabling of the 2010 budget was hindered.

The five, he said, were Chan Ming Kai (Simpang Pulai), Chang Lih Kang (Teja), A. Sivasubramaniam (Buntong), Thomas Su (Pasir Pinji) and S. Kesavan (Hutan Melintang). (more…)
